Building Disputes

Despite the best intentions, there are times when disputes or complaints may arise over building standards, workmanship, building contracts and dividing fences.

The Building Commissioner has powers to deal with certain complaints relating to building, painting, plumbing and design certification services including;

  • the quality of work that has been carried out; and
  • a Home Building Work Contract.

There are a range of ways that the Building Commission can assist to resolve your complaint under the Building Services (Complaint Resolution and Administration) Act 2011.  Each dispute is unique and, following an assessment of the complaint, a suitable resolution process may be commenced. 

Payment Disputes

Payment disputes that arise in respect to construction contracts between owners, builders and subcontractors can be resolved under the Construction Contracts Act 2004 through a rapid adjudication process.

Dividing Fences

A dispute relating to a boundary fence may be resolved between neighbours under the Dividing Fences Act 1961.  See the Dividing Fences page for further information.
